Awnly Terms & Conditions of Sale

These terms govern your use of the Awnly website and the sale of our products and services. Please read them carefully. By placing an order you agree to these terms. In these terms "we", "us", "Awnly" means Awnly Pty Ltd (ABN 54 700 229 607), and "you" means the customer.
1. Our products are made to measure
Most Awnly products (awnings and blinds) are custom-made to the specifications and measurements confirmed for your order. Because they are made to your requirements, they cannot be cancelled, returned or refunded for change of mind once fabrication has begun. This does not affect your rights under the Australian Consumer Law for products that are faulty or not as described (see clause 8 and our Returns & Refunds Policy).
2. Quotes and pricing
"From" prices shown in collection listings are the starting price for the smallest standard size and are a guide only. Where a product has an online configurator, the price it calculates from your measurements and options is the price you pay at checkout. If we provide a written quote, it is valid for the period stated in that quote. All prices are in Australian dollars and include GST unless stated otherwise. If a pricing error occurs we may cancel and refund the order before fabrication begins (see clause 3).
3. Orders
An order is accepted when we confirm it in writing and payment (or the required deposit) is received. We may decline or cancel an order before fabrication begins — for example if a product is unavailable, a pricing error has occurred, or measurements cannot be verified — in which case we will refund any amount you have paid for that order. You may cancel your order for a full refund at any time before fabrication begins — normally the first business day after ordering — by emailing hello@awnly.com.au; after fabrication has begun the order cannot be cancelled (see clause 1).
4. Measurements, installation and use
Measurements. You supply the measurements for your order and you are responsible for their accuracy. Our guides walk you through measuring — please measure carefully and check your figures before confirming, because made-to-measure products cannot be remade or returned for incorrect measurements.
Supply only. Awnly supplies products only; we do not install them and we do not inspect your site. You (or your installer) are responsible for choosing suitable fixings, for confirming that the wall, fascia, beam or post can carry the loads involved, and for installing in accordance with the manufacturer's instructions and any council, strata, heritage or other approvals that apply to your property. Where structural certification is required (for example for fixed canopies, large folding arm awnings or any awning over a public footpath) you must engage a suitably qualified engineer. Hard-wired 230 V motors and sensors must be installed by a licensed electrician. Damage caused by incorrect installation, unsuitable fixings or an inadequate substrate is not covered by warranty.
Weather. External blinds and awnings are shade and weather-reduction products, not storm protection. They must be retracted or raised in strong wind, hail or storms. Any wind figures we quote are the manufacturer's test results or ratings for the product and depend on your fixings and substrate; they are not a certification of your installation. Weather damage is not covered by warranty.
Colours and images. Fabric and powder-coat colours shown on screen are indicative — order a swatch if colour is critical. Product photos may show optional accessories or other models in the same family. Where a mill discontinues a colour we will contact you to agree an equivalent before fabrication.
5. Payment
We accept the payment methods shown at checkout, processed through our payment providers. Title in the goods passes to you on full payment. Risk passes to you on delivery.
6. Delivery
Delivery timeframes are estimates and depend on fabrication lead times and your location (see our Shipping Policy). We are not liable for delays outside our reasonable control. Please inspect goods on delivery and report any visible damage promptly (see clause 8 and the Returns & Refunds Policy).
7. Warranties
Manufacturer product warranties apply to the products we supply and are passed through to you. Full details are in our Warranty Policy.
8. Your rights under the Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures you are entitled to a replacement or refund, and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure. Nothing in these terms limits or excludes these rights.
9. Liability
To the extent permitted by law, and other than the guarantees that cannot be excluded under the Australian Consumer Law, our liability for any product or service is limited, at our option, to the repair or replacement of the goods, the resupply of the services, or payment of the cost of doing so. We are not liable for indirect or consequential loss.
10. Privacy
We handle your personal information in accordance with our Privacy Policy.
11. Disputes and governing law
These terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of its courts. If you have a concern, please contact us first at hello@awnly.com.au so we can try to resolve it.
